Task Force Notice of Policy Update August 18th, 2020
To The Claremont Colleges Community:
This message is in follow-up to the communication sent to The Claremont Colleges community on Monday, August 17, 2020.
As we shared in our earlier letter, an important part of the Task Force’s charge was developing a common Title IX Grievance Process that is consistent with legal requirements, including the recent regulations adopted by the Department of Education’s Office of Civil Rights (OCR) which required implementation by August 14, 2020. In order to ensure The Claremont Colleges has the best policy possible that is also responsive to our community to the degree possible, the Task Force will continue to track OCR guidance and other resources during the public comment period. In certain, limited, cases, we anticipate this may require updates to the interim policy to comply with regulations and supplemental guidance during the comment period.
At its August 17 meeting, the Task Force reviewed three proposed clarifications to the interim Title IX Grievance Process that are important for inclusion in the linked, revised interim Title IX Grievance Process (dated August 18, 2020):
- Clarification that The Title IX Grievance Process will only apply to conduct alleged to have occurred on or after August 14, 2020. (p.31)
- Clarification that the determination of whether reported conduct falls within Title IX will be made by the Title IX Coordinator, or Title IX Coordinators for Complainant and Respondent in cross-campus cases. In circumstances where the Title IX Coordinators may disagree, the TCC Title IX Administrator will make the final determination. (P.13)
- Addition of an appeal process in relation to the determination of a complaint falling under Title IX. (p16)
